Safety Waiver & Release
Important Notice
All participants must read, understand, and sign this waiver before participating in any jet ski tour. Minors require a parent or guardian signature.
1. Assumption of Risk
I understand and acknowledge that jet skiing and water sports activities involve inherent risks, including but not limited to: collision with other watercraft, submerged objects, marine life encounters, weather-related hazards, and physical exertion. I voluntarily assume all risks associated with participation.
2. Physical Fitness Declaration
I certify that I am physically fit and capable of participating in jet ski activities. I have no medical conditions that would prevent me from safely operating a personal watercraft, including but not limited to: heart conditions, back problems, epilepsy, or pregnancy. I agree to inform the tour operator of any medical conditions before the tour begins.
3. Alcohol and Substance Policy
I understand that operating a jet ski under the influence of alcohol or drugs is strictly prohibited and illegal. I agree that I will not consume alcohol or impairing substances before or during the tour. The tour operator reserves the right to refuse service to any participant suspected of impairment.
4. Equipment Responsibility
I agree to operate the jet ski equipment responsibly and follow all instructions provided by the tour guide. I understand that reckless operation, including excessive speed near other watercraft, swimmers, or wildlife, will result in immediate termination of the tour without refund. I am responsible for any damage caused by my negligence.
5. Marine Life and Environment
I agree to respect marine life and the natural environment during the tour. This includes maintaining a safe distance from dolphins, manatees, sea turtles, and other wildlife. I will not chase, harass, or feed any animals. I understand that Florida law protects marine life, and violations may result in legal penalties.
6. Release of Liability
In consideration for being permitted to participate in the tour, I hereby release, waive, discharge, and covenant not to sue St. Pete Jet Ski Tours, its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me during the tour.
7. Photography and Media Release
I grant St. Pete Jet Ski Tours permission to use photographs, videos, or other media captured during the tour for promotional purposes, including but not limited to: website content, social media, advertising, and marketing materials. I waive any right to compensation for such use.
8. Age Requirements
Participants must be at least 18 years old to operate a jet ski. Passengers must be at least 8 years old. All minors must be accompanied by a parent or legal guardian who must also sign this waiver. The tour operator reserves the right to verify age with valid identification.
9. Insurance
I understand that St. Pete Jet Ski Tours carries liability insurance as required by Florida law. I acknowledge that this insurance may not cover all potential losses or injuries, and I am encouraged to obtain my own personal accident and travel insurance.
10. Governing Law
This waiver shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising from this agreement shall be resolved in the courts of Pinellas County, Florida.
